Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the Sucheus website, mobile applications, and related services (collectively, the “Platform” or “Sucheus”), operated by Sucheus (referred to as “we”, “us”, or “our”). By accessing or using the Platform, registering an account, or clicking to accept these Terms, you agree to be bound by these Terms, our Privacy Policy, and any additional policies or guidelines incorporated herein (collectively, the “Agreement”).
If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity. If you do not agree to these Terms, you must not access or use the Platform.
1. The Platform and Our Role
Sucheus is an international multivendor online marketplace that connects Clients (buyers of services) with independent Service Providers (vendors/sellers of services) for the booking and delivery of professional services (e.g., Entertainment, Handyman, IT & Graphics, Professional Experts, Services & Hospitality, Learning & Tutorship, and others).
We act solely as a facilitator and marketplace. We do not employ, supervise, control, or direct Service Providers. Service Providers are independent contractors who set their own prices, availability, schedules, and methods of service delivery. We do not guarantee the quality, safety, legality, or completion of any service, nor do we endorse any Service Provider or Client. All services are provided directly between the Client and Service Provider under their mutual agreement.
2. Eligibility and Accounts
You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Platform.
To use certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update it promptly. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized use.
We may suspend or terminate accounts for violations of these Terms, suspected fraud, inactivity, or at our discretion.
3. User Conduct and Prohibited Activities
You agree not to:
• Use the Platform for any illegal purpose or in violation of any applicable law.
• Circumvent the Platform (e.g., conduct transactions off-platform to avoid fees, escrow, or protections).
• Post false, misleading, or infringing content.
• Harass, abuse, or discriminate against others.
• Impersonate any person or entity.
• Interfere with the Platform’s operation (e.g., hacking, viruses).
• Use automated means (bots, scrapers) without permission.
We may remove content or suspend/terminate accounts for violations.
4. Services and Booking Process
Clients may browse, filter (by category, location, remote/onsite, date, price, reviews), and book services.
Upon booking:
• Payment is processed securely and held in escrow.
• The Service Provider receives notification and may accept the order as-is or propose adjustments (e.g., date/time, hours, location, which may affect price).
• If adjustments are proposed, the Client reviews and accepts/rejects. If accepted, the order returns to the Provider for final acceptance.
• Once both parties accept, the order becomes active.
Service Providers must deliver services professionally and as agreed. Clients must provide necessary access/information and cooperate reasonably.
5. Payments and Escrow
All payments are processed via PayPal or SWIFT/bank transfer. Platform fee: minimum $10 or 10% of the transaction value (whichever is higher), deducted from the total.
Funds are held in escrow upon Provider acceptance:
• Client confirms service completion on the order page.
• Upon confirmation, payment releases to Provider after 30 days.
• If Client does not confirm, funds release to Provider after 45 days (unless disputed).
• Client has 21 days from completion to file a dispute/refund request with evidence (photos, videos, descriptions).
We facilitate escrow but are not a financial institution. Payment disputes are handled internally first; we may involve third-party processors. Late payments may incur fees or suspension.
6. Cancellations, Refunds, and Disputes
• Cancellations: Possible at least 24 hours before service start (full details in Guidelines). Late cancellations may incur fees or Provider discretion.
• Disputes: Clients/Providers use the “Dispute” button on the order page. Provide evidence. We investigate impartially (typically within 48 hours) and may mediate, adjust funds, or decide based on evidence and policies.
• Our decisions on disputes are final for escrow release. Parties may pursue external remedies if allowed by law.
7. Fees and Taxes
We charge the platform fee on each completed transaction. Service Providers are responsible for their own taxes, licenses, insurance, and compliance. Clients may face taxes depending on jurisdiction.
8. Intellectual Property
All content on the Platform (text, graphics, logos) is owned by us or our licensors. You grant us a worldwide, non-exclusive, royalty-free license to use, display, and promote your listings, reviews, and content on the Platform.
You retain ownership of your content but warrant it does not infringe third-party rights.
9. Reviews and Feedback
Reviews must be honest and factual. We may remove reviews that violate policies (e.g., fake, abusive).
10. Limitation of Liability
To the fullest extent permitted by law, Sucheus is not liable for:
• Service quality, delays, damages, or injuries from services.
• User conduct or disputes between users.
• Indirect, consequential, incidental, or punitive damages.
Our total liability shall not exceed the platform fees received from the relevant transaction in the past 12 months.
11. Indemnification
You agree to indemnify and hold us harmless from claims arising from your use of the Platform, your content, your services/transactions, or violation of these Terms.
12. Termination
We may terminate or suspend your access at any time for any reason, including violations. Upon termination, your account obligations (e.g., payments) survive.
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of Nigeria/Federal Capital Territory or specify jurisdiction, e.g., England and Wales for international neutrality.
Disputes shall first attempt informal resolution. If unresolved, parties agree to binding arbitration in [Abuja, Nigeria] under applicable rules (or courts if arbitration not feasible). No class actions; individual claims only.
14. Changes to Terms
We may update these Terms. Continued use constitutes acceptance. Check for updates regularly.
15. Miscellaneous
• Entire Agreement: These Terms (with Privacy Policy) constitute the full agreement.
• Severability: Invalid provisions do not affect others.
• No Waiver: Failure to enforce does not waive rights.
• Force Majeure: Not liable for events beyond control.
• Assignment: We may assign these Terms; you may not without consent.
